I'm not sure I fully understand your question but you are not required to claim medical damages in a car wreck. However, you are much more likely to get an attorney to take your case if you get checked out after a car wreck because attorneys are generally able to increase the value of your claim if there is some kind of medical damage. If you aren't injured then great (that really is better than a monetary attempt to make you whole)!
If you have medical bills then it would make sense to claim those damages as it will be covered. Even if you are at fault it will be covered up to $10,000.00 with no charge to you if you did not have a PIP deductible. Let me know if you have any other questions.
