Home Owners Insurance not paying

Three years ago at age 14 my daughter knocked her front teeth out on a neighbors trampoline. Emergency Room, Dentist, Plastic surgeon, Orthodontist, Endodontist and $7500 later the teeth and her lips were back like original. The neighbors home owners gave them a check for $500 and canceled the policy. The neighbors then wrote us a check for $500.

Now the teeth are infected in the gums and need removed. We are going to have an Oral Surgeon remove the teeth and graft bone to support the gum. A dentist is going to need to make a retainer with false teeth. When she is 18 we are going to need to have permanent replacement attached to the bone by the oral surgeon. We are looking at another $7,000 to $10,000.

We contacted the Insurance company and they told us we are out of luck.

What should we do?

This is one circumstance where an attorney really cannot provide solid advice in this forum. There are many factors to consider regarding the statute of limitations involved, whether the statute of limitations has been tolled, and what kind of claim should be filed.

The best advise I can give you is DO NOT DELAY and go see an attorney that handles personal injury cases to discuss all the details and especially the statute of limitations issues.
