Legal Question in Insurance Law in Kentucky
My husband was in a car accident where the other car came the wrong way through a stop sign and came the wrong way on the road. his insurance refuses to pay saying that the wreck would have occurred whether he took the correct path or not because he had damage to the back side of his truck. This is not true. There was no damage to his truck. Do they have to provide me with picture evidence and a copy of their insured's statement?

The insurance company is obligated to provide prompt payment for your legitimate claims and, if they deny your claim, they are obligated to explain to you exactly why they are denying the claim. Insurance companies (most of them) routinely deny claims from individuals not represented by an attorney if they can think of some reasonable basis to do so. Attorneys, such as myself, argue with the insurance company and highlight the reasons for why your claim should be paid according to your policy. If you have a claim that should be paid by another insurance company then I would go to that company and start negotiations with them.
They must provide you with evidence and information known as "discovery" only once a lawsuit has been filed.
