Legal Question in Military Law in Kentucky
does a sfc with 19 yrs of service being processed for separation get to retain his retirement pay and benefits
1 Answer from Attorneys
That depends on what happens and what kind of a discharge is awarded. As a general rule, if you are discharged at 19 years, you probably will not receive retirement You typically have to get to 20 years to receive retirement. What kind of a discharge are they wanting to give you and for what reason? If it is anything at all adverse or something which you do not want, you should demand an administrative discharge board to fight the proposed separation. At this board, you can fight the basis for the separation, any separation at all or even the type of discharge. Make sure you consult with an attorney soon as you have too much time in to just lose everything.
