Legal Question in Personal Injury in Kentucky

Judicial appeal question?????

Question, If a judge were to dismiss

a franchise corporation, so that the franchisee, were responsible for massive physical damages to a child, which includes many plastic surgery operations at a very young age, could a appeal on the judges ruling, to dismiss the franchise corporation, be in order, after 1 year from the ruling?

This has happened in Kentucky, and the mother is accepting payment from the franchisee's insurance company...if she could win the appeal, and sue the franchise company, would the mother jeopardize the lawsuit, by accepting the payment?

What would any of you advise?

Re: Judicial appeal question?????

Here is what I assume you are telling me: That the mother of a child has settled a claim against a franchise operation, and is getting payments from their insurance company. It also appears that the judge in the case made some sort of ruling about a year ago.

Assuming this is correct, (1) the case looks settled to me, and settled is settled--nothing more to do except take the money; (2) you cannot appeal a ruling that is more than a year old.

Ask a local attorney about this.
