What is a summary judgement

can a summary judgement be filed in both a civil

and crimial case.

Genarally speaking a summary judgment is a motion that is filed after a lot of the facts have been "discovered". The motion says that even with all of the facts in the lawsuit, that you have no case under the law.

When a motion like this is filed, you and your attorney need to respond and show how the facts make a case under the law.

I so not know about summary judgment motions in criminal cases. I do not practice any criminal law.
