Legal Question in Real Estate Law in Kentucky

The buyer in Land Contract responsibilities for damage

I had an 11 year land contract. I lived there for almost 6 years. I decided I no longer wanted to live there anymore and offered the seller the property back. The seller told me that we would just change it to a rental agreement. I was fine with this. Then when it came to time to sign the paper it was actually that I was rescinding the original contract. To date the second form has never been filed. Now the owner is trying to sue me for repairs that need to be done. There was nothing in the original contract covering this. I think they are getting bargain since I could have just quit paying and the seller would have done a foreclosure. My understanding is that once the paper that states I rescinded the original land contract it was as if I never lived there so how could I be responsible for anything?

Without reviewing the documents, it's difficult to say what responsibility, if any, you have under the agreements. Unless I have more details, I can't honestly give you an opinion as to the nature of your potential liability for the alleged damages under the suit. Feel free to call to discuss further. 859-491-5800
