if a contractor subcontracts a job who is overall responsible for any liabilities

The contractor is still responsible to the individual or company who hired him, however, the subcontractor has probably in some way indemnified the contractor, if there was a written contract. (Generally, though, I'd go after them both and left them figure out who's actually on the hook.)
