Legal Question in Real Estate Law in Kentucky

Landlord Lied About Death In House

Because of our religious beliefs we can not live in any home that someone had died in. Last year we rented a home in California, informed the landlord of our beliefs and were reassured that no one had died there. We later found out this was untrue. Now we are relocating to Kentucky and are worried we will have the same problem there. So we have three questions:

1. Is there some way to find out if someone has died in a home through some kind of online public records and if so where is it as we can not find it.

2. If we inform the new landlord of our beliefs before renting a new home and they lie to us are they legally responsible if we find out that they were lying and have to move?

3. Is it possible to stipulate this rule in any future rental contracts so that we have legal recourse if the landlord decieves us?

Thank you for your time.

Re: Landlord Lied About Death In House

Question 1: If the Court determined the lie to be a material misrepresentation of a known defect, you could recover damages, but only if you prove injury. I see no injury.

Question 2. No.

Question 3. Not likely in Kentucky. I would suggest you move to Alaska and build an igloo.
