Legal Question in Real Estate Law in Kentucky

Hello, I live in Louisville, Kentucky and I have a question regarding a home I purchased. In 2003 I purchased a home with my then girlfriend. I left the home in October 2005 ending the relationship. She remained in the house and continued to pay, though both our names were on the loan with me being the primary. I have asked on several occasions that she refinance, move out allow me to refinance, or sell. We tried to sell in 2008 but had no success due to the market and over pricing of the property. I have recently asked her to sell, refinance, or move out and allow me to refinance. In short she has been uncooperative in trying to resolve the situation, and she has also not been paying consistantly thusly ruining my credit in the process. Is there anything that I can do legally to try to get this resolved?

Probably not, but I suggest you go talk to a family law attorney who is experienced in dissolving the relationship between cohabitating couples. Might start with looking for one who works with gay couples, since they often have comingling of assets like this, but are not legally married.

Honestly though, this issue often happens with married couples, often with no recourse. And if she has been missing payments and her credit is bad, she won't be able to refinance anyway.
