Propertty Management

I have a property management company managing a rental property states away from where I live. The property management company has done a dismal job. My contract with them has just expired and I have already found a new property management company to hire. My question is two parts:

1. When the property was taken over by my current management company I had to evict a tenant in which the management company handled on my behalf. I won the award of over $3,000 in which the tenant owes me plus cost for law fees etc� I have yet to collect and the current management company had their lawyer do this in which now they are going to garnish the wages. If I fire this management company would I have to do this judgment new lawyer etc� all over if I want to get my money from the first tenant?

2. I reluctantly allowed my property management company to lease to a section 8 tenant. Again if I change property management companies would that cancel my lease with the section 8 tenant and also have to have the section 8 department come and reevaluate the property?

This is a question more properly posted to a KY lawyer. California law will generally not govern the questions you posed, as you are dealing with a property management company in KY, a KY lawyer and section 8 in KY. With respect to the attorney, you need to find out who was his client - you or the property management company. Further, in whose name was the judgment awarded. Both should have been you, but I have seen things done completely wrong in similar situations. Re-post this to KY attorneys, and good luck - sounds like a bad situation.
