what are my rights
my husband and i bought a house from our local bank that was auctioning the house off in august 2001.the house we bought was my husbands homeplace where he was raised and we didnt want it to get out of our family so we bought it to give to our children.the problem is that my husbands brother lived in the house at the time of the sale and he is still there with his family now.we couldnt make them leave because they have 3 kids and we didnt want them to be homeless ,also my husbands brother told us he would give us the money back for the house if we would sell it back to them because he said the bank wouldnt let him bid on the house.we never agreed in writing or anything we just waited for them to get the money. but no one will loan him any money because he constantly buys stuff and doesnt pay for it he also filed bankrupsy and lost everything he has.he has been giving us the payment amount each month for the house but he is always 5 or 6 days late. we want to no how we can get him out of this house so we can sell or rent it to someone who can pay for it as we are low on money and we dont want our credit ruined by him not paying the payment on time.we are currently broke because of this and cant afford a lawyer

You should go to your local District Court Clerk's office (likley in the local courthouse) and get the forms to file to have your brother-in-law evicted from the house. There are forms for the process and you can do them yourself. Depending on where you live, the clerks may be able to help you fill out the forms. You may also want to check with your local County Attorney for assistance.
