Legal Question in Real Estate Law in Kentucky

Seller Lied on Disclosure

Seller stated that they never had any leaking or flooding problems with the house on their disclosure statement. Last week my basement flooded, after talking to neighbors I learned that it flooded on them right before they moved out and they totally refinished the basement to cover it up. Now I have to dig up part of the yard and reroute drain tile to fix the drainage issue. Do i have a case against them. We might have never bought the house and we definitely would not have paid the asking price if we knew it had flooded in the past

Re: Seller Lied on Disclosure

You may have a cause of action against the prior owner, the appraiser, the inspector and the real estate agent depending on what information you had at the time you purchased the residence. You should keep pictures of the damage, have multiple persons give you an estimate of the damage and consult an attorney before you proceed to fix any damage.
