Legal Question in Real Estate Law in Kentucky

In the state of Kentucky, when one of the owners of the property dies, is a land contract void? There is a mortgage on the property that was in both of the owner's names. The surviving owner wants out of the contract, but the land contract holder does not want out.

Depends on what the contract says, but it is probably not voided upon death of one party to the contract. If it is silent on the matter, it would not relieve the other signer of the obligation to pay. I would suggest taking the contract to an attorney for a formal opinion on the matter.
