My spouse and I want to buy a house and several acres at a commissioners sale. We are part owners. One of the owners has lived there for many years and will still be living there when the property sells. We would like to know the proceedure for getting this person out of the house after the sale. The person does not and has never paid rent. We do not believe they can afford to purchase the property. The person in the house has stated they will not leave even after sale. What can we do? What steps, and how long will it take? Can we file papers to get person out ourselves or do we need a lawyer?
They do not allow other owners in house, and court will not remove them before sale

Once you have title, you will need to go to district court and file a forcible detainer action. How long this will take depends on your county, because not all counties hold motion hour every week. Check with your clerk's office to find out when court is held, and what the timeline is. If you're confused by the process, hire an attorney.
