Legal Question in Real Estate Law in Kentucky

Subleasing

I had a roomate to sublease off of me due to her credit rating being to low to by put on the lease. I have a notarized agreement with her that she is to pay half of the bills NO MATTER WHAT the reason is that she leaves. She moved out 6 months into the lease and didn't pay her portion. I am suing her but the apartment complex is saying that I owe 1,800.00 to break my lease for fees and the first months rent that i got as a freebly to get me to move into the complex. Can they techniqually make me pay this? also, since she subleased off of me is there some sortof law against the apt trying to make me pay this back since I am a student and couldn't afford the rent by myself? any help would be great!

thanks

Re: Subleasing

The lease agreement is between you and the apartment complex. Your departed room mate owes you money on the agreement between you and her. It does not matter who or what you are. The fact is that the apartment complex can enforce the lease against you and you alone. They have no agreement with your room mate. While there may be some question about some of the charges, which you can attack as "inflated", "waived" (e.g.first mo rent) you are responsible to the apartment complex on the terms of the agreement.
