Legal Question in Traffic Law in Kentucky
No Insurance
In early 2003 I was preparing to be deployed to Afghanistan to serve in the Army. Before my deployment a verbal agreement was made between me and my best friend that he would attempt to sell my vehicle while I was overseas. With two witnesses present I told my friend that I had cancelled the insurance on my vehicle and that he was not to operate the vehicle for any reason. We also agreed that he would be financially liable for anything that happened to my vehicle under his watch.
Shortly thereafter my friend chose to drive my car and he caused an accident that resulted in his death. His father was one of the two witnesses that was there when our agreement was made not to drive the car. His father is now the executor of his estate and the executor of the large inheritance my friend had just received.
Since my return from war the father of my friend (who is now deceased) has mentioned compensation but has never followed through. Morally I feel bad asking for money when I lost my best friend. But being only 25 years of age I purchased a new vehicle and paid for it in full becuase I had been promised compensation. Now I'm finding myself hurting financially. Am I entitled to be compensated for the value of my vehicle?

Re: No Insurance
Don't do business with your best friend. Owner of vehicle is responsible for insurance. The Soldiers and Sailors Relief Act may provide some shield, but I'd keep silent and behappy that you arn't being sued for something.
