Legal Question in Wills and Trusts in Kentucky

beneficiary

My mother just recently passed, she had life insurance. She filled out the beneficiary form, (i know cause I helped her fill it out), now the company she works for says that she didn't have one filled out, in other words they have lost or misplaced this form. Anyways, they are telling me that it is in there lawyers hands to see who get the life insurance. I'm having alot of people tell me that if no beneficiary wasn't named it automatically goes into probate court. Then i'm having people tell me that it will go to her spouse ( she is divorced) if there isn't a spouse that is goes or gets split between her childer. I need to know what the truth is. Thank you.

Most policies provide that if no beneficiary can be determined, the policy proceeds are paid into the estate to be distributed as the estate is distributed. Read the Policy.
