Legal Question in Wills and Trusts in Kentucky

Executor Using Judge as Witness to Defend Exhorbitant Fees

We are challenging an Executor's fees in an up-coming Hearing that are in excess of the 5% we expected. The Executor is using a judge as a witness against me who decided an earlier case a few ago in my favor, but in a different court. The Executor is also calling lawyers and employees from his firm or his lawyer's firm as witnesses. Is this unusual?

If the matter was complex or required more time than would be covered by the 5% fee you were expecting, then the Executor would bring in witnesses to testify to that.

it is unusual. your steps would depend on what it would cost to defend against the cost to pay the executors. it may also be that by bringing all these folks, the executor my be wasting estate resources. call me & we can discuss this.
