when no last will can be located who is the executor of the estate.

When no will can be found, a person or party may petition or apply to the District Court to be appointed as administrator of the deceased persons estate. The law of Kentucky gives a preference to the spouse of the deceased person in regards to being appointed administrator. If there is no spouse or the living spouse does not wish to serve then normally one of the children or close relatives will normally have the best chance of being appointed as the final decision is made by the judge of the District Court upon a hearing for a request for appointment by a petitioning party. Depending upon the size of the deceased persons estate, you may wish to consult an attorney as to the necessary steps to be taken in the matter. If the deceased persons estate or assets are minimal then there are forms available at the district court clerks office that may allow for probate to be streamlined or dispensed.
