Executrix Fees
How can I identify the assets to which Executrix fees are applied? Probate assets or estate tax assets (difference being assets held within a Trust)
also, how can I identify assets to which Trustee fees can be applied? Are the Trustee fees the same for a ''revocable'' trust and a family trust?

I can only give you some general ilnformation. To get a workable answer, you will need to consult an attorney who can review the estate documents, etc. In Kentucky, Executor and Administrator fees are usually computed on the value of the personal estate. Real estate does not pass through the hands of the representative but passes to the beneficiary at the moment of death. How the will is set up can change some of this. Also, if the representative has to deal with the real estate in an extraordinary fashion, the court may allow an additional fee. You mentioned a trust and how these assets figure in the computation of a fee for the estate representative depends on how the assets go to the trust, etc.. Again, you need to set down with someone who can get ALL of the facts that are LEGALLY important. You may overlook some of these things and it can be a costly mistake - potentially, much more than the consultation will cost.
