Legal Question in Wills and Trusts in Kentucky

My Mom drafted her will in 1979. Although it is old, she only needs to make one change. She lives in KY and wants to change the name of the executor. What's the easiest way to do this?

It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case. You should have a lawyer look over your mom's will.

The easiest way to change the name of the executor is to add a written "codicil" to the end of the will, indicating the change. This codicil, or amendment to the will, needs to be signed by your mom, dated, and signed by her in front of 2 witnesses, who also must sign.

You should not take any action, based upon my advice, without consulting an attorney and explaining all the facts to him. You are best advised to seek the services of a competent Kentucky attorney. You can telephone your local bar association for a referral, or can find a good lawyer on-line at the Kentucky Bar Association's Lawyer Referral Service:
