my father and stepmom had a joint will in kentucky,my dad passed in 2005 and his will was never probated,it this legal to handle it like that?

Much more detail is needed to know whether something is being done incorrectly here. But, the general rule is that if there is a will, it should be probated so that it is given legal effect.
