Probate of Will

My father recently died with a will. The will reads the same for my mother and father. It is a joint tenancy will. Do we have to probate the will? Everything he had goes to mom and everything mom has goes to dad, however dad just recently died. Mom is still living. Mom and Dad's name is on everything they had. There are no outstanding debts etc. Everything is paid for, they only have house, car and a bank account etc. No real estate ventures etc. It is very simple will for both.

The will should be probated. If it is not probated within ten years, the property goes by statute. Do your mom a favor, get it probated.
