Legal Question in Wills and Trusts in Kentucky

Time limit to probate will?

My father passed away in December last year. It is a large estate with many creditors, one of which is being very impatient and saying we are taking to long to probate the will, and is going to court over it already. Is there a time limit stating when you have to probate a will in KY with creditors waiting? Also, is there an allowed period of time for reorganization for the family of large estates? My brother is a lawyer but doesn't have much experience in this type of law. He is the one handling the estate, but my mom is getting worried that we aren't being given enough time to reorganize before the creditors attack.

Thanks!

Re: Time limit to probate will?

You have ten years to probate a will. Without knowing the business structure of you father, I would be unable to advise you on this. Don't be impatient. Your brother may be more aware than you think. The creditors cannot do anything until an estate is opened. They can, of course, petition to open an estate. You do need local counsel and I am sure that your brother may already have someone in mind if he feels that he cannot handle it.
