Will we ever be paid?

My uncle passed away last October and left his estate to his neices & nephews. The executor is a cousin and she took care of auctioning his house, property, etc. She hired a lawyer to take care of paying out to the heirs. We've not received anything yet and we keep getting the run-around. Everytime we ask when we'll get the money, we're told ''just a couple of more weeks.'' Then we were told we'd get the money within two weeks after a year passed, which it did 10/01/06. When we asked during the first week of October, were were told middle to end of the month. I just spoke to the lawyer's office and now they're saying ''another month.'' We just can't seem to get any straight answers and it's starting to make all of us very concerned. We've never been given a copy of the will, nor have we even been told how much the estate was worth and how much we'd all be getting. Do we need to hire our own lawyer in order to get our money?

Unfortunately, when an estate needs to be probated, there are often time delays in distributing the assets - for various reasons.

If you believe that the attorney and your cousin are giving you the "run around," then you should put your inquiries in writing to the attorney, asking when you can expect to receive the distribution and the accounting for the estate.

If that doesn't work, I would definitely recommend speaking with an attorney to represent your interests.

If this estate is in Kentucky, you should consider hiring a local KY attorney to dsetermine your rights. You may be very well be entitled at a minimum to an immediate accounting. The "run around" may be completely innocuous or it may indicate a serious problem. Hard to say without knowing a lot more.
