Legal Question in Workers Comp in Kentucky
Supervisor witnessed my accident and never turned it in/ I required surgery thre
I injured my right knee at work due to another employees negligence; my supervisor/owner, witnessed the accident and never reported it or asked me to go to a doctor. Three months later i required surgery and am limited in my motoring skills now. During the time up to my surgery I wore a knee brace. What can I do? And do I have a case? Thank you

Re: Supervisor witnessed my accident and never turned it in/ I required surgery
You do have a case but you will have to prove it. I'm not sure what you did in the three months prior to your surgery. Did you go to an emergency room? Did you go to a clinic? You must have go to a specialist at some time prior to the surgery. You case can be proven through those medical treatment records or some other eye witness. But you can't simply blame the supervisor for not reporting the accident and expect to win a case. You should consult with an attorney in your state who does Work Comp cases. The initial visit and the work he does is usually free until a recovery is made for you. Good luck.
