Legal Question in Immigration Law in Lebanon

fiance or marriage visa

my brother just got engaged to a girl in lebanon. Would it be better for him to apply for her to come as a fiance or to get married there and apply for her as his wife? He is in the air force here in the US.

Re: fiance or marriage visa

Either way would work, 6 in one 1/2 dozen in the other. Fiance is a bit quicker, but then requires some additional steps. In order to qualfy as Fiancee' of a US citizen at the time of the application the parties must have had an IN PERSON meeting within one year. I.E. telephone and letters are not enough. He needs nice pictures of the engagement meetings, the ring, etc. Then, once the VISA is issued by a consulate office, the Fiance can travel to the U.S. Within 90 days of the entry, the couple must get married. They must also promptly file for adjustment of status with all the required documents and papers with the appropriate USCIS offices. At that point a work authorization and conditional green card will be issued. After 2 years (w/in 90 days in advance) they must file for adjustment of status as permannent resident to remove the "conditional" status. There will be at least one interview at USCIS prior to removal of that condition. Once the immigrant spounce has been here for 3 years, she can apply for Citizenship, which is highly recommended. SHe can apply within 90 days of the completion of the full 2 years. i.e. if she leaves the country for a 3 week period or something, that time will be deducted from the 2 years, so she will have to wait an additional 3 weeks to qualify for U.S. Citizenship. Its technical and complicated. A good lawyer is very helpful. We can do all this for a flat fee of $2,500 in advance or 3 equal quarterly payments of $1,000. THis includes all the processing and interviews here in the U.S. plus any necessary filing fees and reasonable expenses. Best wishes, AP
