First and second offense DWI's brought under Louisiana Revised Statute 14:98 are misdemeanors. A DWI can be charged as a felony after the second conviction with special conditions placed upon the time and sequence of the arrests and convictions.

This depends on if the driver has prior convictions for the same offense.

In Louisiana first or second convictions are misedmeanors. A third or above within a 10 year period is a felony.
