Legal Question in Civil Litigation in Louisiana
stolen money
About three months ago, I was searching for a house. I got the help of a man who owns a construction company and also has connections in real estate. The only reason I tried to do things this way, is because I am an exotic dancer and it would be very hard for me to get financing through a bank. He told me that in order to hold any houses that I may be interested in, he would need money to put down payments on them. I wrote him a check for 3,000 dollars which he said I would get back if I didn't like the houses. After a month of no progress, I told him that I wanted my money back. He wrote me a company check which came back NSF. Since then, he keeps telling me that he will give me a cashiers check next week which he hasn't. For the past week or so, he has been impossible to reach. I don't have a promisary note or a contract, the only proof that I have is written on the check. Is this sufficient enough to take him to court? Someone also told me that I could go to my local courthouse and file a report since he is stealing. Is this true?

Re: stolen money
Every District Attorney's office has a "Worthless Check" section. Contact them and they will help you collect. $3000.00 is a lot of stolen money and He will probably pay restitution to stay out of prison.
Re: stolen money
From the facts that you have given, you should call the District Attorney's Office in the Parish that this happened and they will handle this as a criminal matter. He may have to pay you back as part of restitution once he pleads out or gets convicted.
Re: stolen money
The check should be enough to prove your case, and the bad check he gave you for $3,000 is a serious crime, which you should also report. Good luck your hard earned money back!
