Legal Question in Disability Law in Louisiana
I am divorced and my exhusband has the house, to date we have not had a property settlement. The house had been foreclosed and was scheduled for auction, however, the day before the auction, my exhusband filed chapter 13 bankruptcy. If this bankruptcy is approved (still in first week of filing) how can I get my name off the mortgage since I am the sole support of our son and trying to start our life over. Will the mortgage company sue me for the mortgage ?

If the home was purchased during the marriage, the debt is community. The motgagor will have to agree to remove your name or itcan be sold and the mortgage repaid.
