Legal Question in Admiralty Law in Louisiana
what can we do?my husband took a drug screen 2 years ago(2009) for a boat company he worked for never recieved a call saying he failed it.. well he got a call saying he failed the one two years ago...(he got the call in 2011) so they relieved him of his duties and wont tell him if he still has a job or not... is there anything we can do bout this situation...

Possibly. Their failure to timely inform him of the positive drug test has certainly prejudiced him, as he can no longer get an independent test to prove that he did not have any drugs in his system. Personally, I would still go get an independent hair analysis done now. Hair tests go back much further than urine test (several months, rather than several days/weeks). While this will not show that he was drug free on the date of the last test, it will show that he has been drug free for several months and that he obviously does not have a drug problem.
