Injury in aircraft on arrival in England
On arrival at Gatwick, another passenger's luggage fell from the overhead compartment injurying a passenger. An incident report made and clinic visited before leaving airport terminal. The airline offerred to pay for repair of watch band and eye glasses. Medical bills are over $6000.00. What law applies to this situation?

If this was an international flight, the Warsaw convention governs. That treaty provides for limitation of liability on the part of an airline; however, it also makes claims within the liability limits easier (and this sounds like a claim within the liability limits). The treaty also governs where suit can be filed, and provides for a 2-year statute of limitations. We have handled these cases, so feel free to contact me.

Given the small monetary amount, this accident will probably fall within the limits of the liability standards set in the Warsaw Convention. Most airlines will settle this case in fairly short order, since it is hardly worth the effort for the small amount of money.
