Legal Question in Banking Law in Louisiana

My father passed away when I was 14. His life insurance money was put in a bank account for me w/ my mom as the primary. Now that I am 18, she will not bring me to the bank to get my money. And the bank told me that my mom is the only one that can withdraw the money, even though my name is on the account. What can I legally do?

Dear LawGuru Friend,

Your question is an interesting one, but

any attorney would need more facts to give

you a good answer. Assuming that there

is no doubt about it that the money is yours,

then you might have to take some type of legal

action against your mother to force her to do

what she is legally obligated to do. Of course,

since it your mother that you might have to take

legal action against, this is a touchy situation.

There may be more to this situation than is

presented by your short question. Should
