Legal Question in Bankruptcy in Louisiana
bankruptcy
My son and his estranged wife have been sued by a creditor, and he is the only one of the two who has a job...so, his check is garnished. Recently, he received additional court papers from a creditor demanding payment for a vehicle they jointly owned.
He makes less than $9/hr, pays $250/mth child support, and has the garnishment taking money from his meager check. If the second creditor is granted garnishment, he will be left with little if anything to live on.
Could he file bankruptcy, eventhough he is already under garnishment?

Re: bankruptcy
Yes, he can still file bankruptcy. Once the case is filed the automatic stay will go into effect and the garnishment will have to stop.
