Legal Question in Bankruptcy in Louisiana

My son was in a motorcycle accident with another automobile which was at fault for the personal injuries he acquired. He has no medical insurance and no UMI coverage. His medical bills has totaled $30,000 all he can collect from the other person insurance is $20,000. He can not pay off the remaining balance of these bills since they total more than collected. My question can he file bankruptcy and if so have it stipulated he had to file due to medical bills that was caused by another person negligience and it be on his credit record for 1 year instead of 10 years.

He can certainly file bankruptcy, but there is no way to "stipulate" what you are referring to. It will show on credit reports for 10 years.
