Legal Question in Bankruptcy in Louisiana
Chapter 7
My husband and I filed a Chpt 7 in Birmingham, AL in 1997. I filed a Chpt 13 in Alexandria, LA in March of this year (2002). The case was dismissed in May of this year. I owe approximately $6,000 in credit card bills I can not pay. Can I file a Chpt 7 again or do I have to wait 10 years from the last date (Jul 97). Can my wages be garnished? If the creditors sue me do I have to go to court? I have contacted numerous credit counseling agencies which advertise that they are non profit - but after all is said and done I will be paying approx $2,000 more than what I acutally owe.

You cannot file another Ch. 7 case until seven years after the other case. However, you are entitled to file a Ch. 13 case and repay a small portion of your debts.
