Communtiy propery lawsuit

I filed a community property lawsuit against my ex-husband for fraud and gross mismanagement of a family corporation.

He has now declared personal bankruptcy, Chapter 7. There is no expectation of collection as there are no assets. Is this lawsuit which has not been set for trial as of yet, stayed?

How can I obtain a lift of stay? I am suing him for future payments from his income. He is a CPA, earns a good living and I am unemployed. (We were married 30 years). The denial of the right to proceed with the lawsuit would greatly hurt me as the corporation has no expectation of any recovery either.

The filing of the Chapter 7 by your ex-husband does stay your lawsuit. As far as your options to file an adversary proceeding, you should contact an attorney to fill him in with all the details.
