Legal Question in Bankruptcy in Louisiana

How to handle credit card collectors without filing bankruptcy?

I have a credit cards which have all been charged off and sold to collection agencies. I am thinking of filing bankruptcy as a last resort. The collection agencies refuse to set up payment arrangements and want payments in full. Is there a way to come to mutual agreements with these collection agencies without filing for Chapter 7? Please let me know what steps I must take.

Thanks for your time.

Re: How to handle credit card collectors without filing bankruptcy?

Short answer -- I have heard of people successfully negotiating for settlements on credit card debts but I think it is rare.

Most credit card companies, collection agencies, and companies who purchase bad accounts, believe bullying people is the best way to get results. I think most companies treat the individual consumer like they are dumb. Therefore, unfortunately unless you get an attorney involved your chances of negotiating with your creditors is not real good. It will depend on what your ultimate goal is. If you want to pay off the debts in full but you need more time to do this then you can simply make your own payment arrangement. What I mean is send in the amount of money you feel you can even if the amount is $15.00. The credit card company is going to say they don't agree to your terms but what are they going to do send back your check? Eventually if you are sued you can file bankruptcy then.

If you are seeking to get a reduced amount -- 20% or 50% then I think you really need to get an attorney involved. There is an attorney in Minneapolis who I know that tells me he has negotiated with excellent results. There is also the option of bankruptcy and this is an excellent option.
