Legal Question in Bankruptcy in Louisiana

how can I get rid of a civil judgement in Louisiana? Bankruptcy? I was criminally charged with theft. I pleaded guilty to theft $300-500. The insurance company then sued me for $75,000 and placed a judgement on me (back in 2004). The judgement is still on me. What are my options to get this judgement gone and my life back ? :(

You can't discharge debts in bankruptcy if those debts are the result of an intentional wrongful act. Civil Judgments for UNINTENTIONAL torts (like car accidents) are dischargeable, but not for intentional torts like theft/conversion. Your best bet is probably to try and work out something with the judgment creditor to get rid of the matter. If they know you don't have means to pay the entire judgment, they may be willing to accept pennies on the dollar to settle it. Insurance companies are often willing to settle for much less just to get something on the debt. Call the attorney handling the matter for the insurance company.
