Used Car

We purchased a New Car with 259 miles. We found papers in glove compartmetn from the previous owner. They returned the car. the dealership said that the miles were test drive miles only. They never told us that the car was previously owned. They also gave the previous owner a $5,000 rebate and offered us a $3,000 rebate. Is the car considered used and do we have a legal case to get a used car price; blue book value?

Car dealers have a certain definition for "new" and "used" cars, but I don't think those matter here. You did not get what you bargained for. You bought what you thought was a demonstator model, not one owned by another. So, I would tell them to take it back. There is something called the Car Dealers Association and they watch out for things like this. Lastly, if the papers you have has the previous owners name on it, call them and find out what was wrong with the vehicle. Something made them give it back. Oh, the 5000 vs 3000 does not mean anything, since they can deal as they want with their customers on rebates.
