As a Franchise Attorney I can only say a review of your entire lease is necessary. If it says gas and other utilities are included in the rent, then it is very likely that a breach of the lease has happened. Whether you need to give the landlord notice of this breach and an opportunity to cure (fix), or whether you can just terminate the lease are issues that can be decided only after a full review of the entire lease. Consult with a good business or franchise attorney in your area for specific advice.
