Instructors Dilema
I'm a part-time instructor at a state ran Technical College. Four months ago the state started running some new software for payroll. I get paid bi-weekly and was shorted $400 on two pay periods four months ago due to the new software. I have not been able to resolve this so I spoke with the labor board about it. They could not help because of me being in education but did recommend that I go to small claims court. My question is they said additional penalty's might be awarded because of the time frame. What would be a reasonable amount per day or week to ask for? The limit for small claims is $3000. This would be unacceptable in private industry but the state thinks they can do what they want. It is the principle!

The law does allow for money damages if an employor fails to pay an employee under certain circumstances. However you can not just ask for a reasonable amount. LA staute (law) determines what you are allowed. Please look at Louisiana R.S 23:631, et seq. to read what you need to do before the employer will be liable for damages and attorney fees.
