Legal Question in Business Law in Louisiana
Trade Laws
I operate a funeral home licensed by the state of Louisiana. I bought a casket from a Louisiana warehouse from a company based in another state. I have been given an account number, paid for the casket and picked it up myself. This warehouse supplies several funeral homes in my city and now refuses to sell me any more caskets. This restriction makes it impossible to compete. The salesman for the area has given his company false information to prevent me from getting merchandise. Being the nearest warehouse (60 mi) I need their merchandise.

Re: Trade Laws
The casket and funeral businesses are a bit different from other businesses in that they enjoy a certain amount of protection from competition. My first impression is that the casket company can sell to whomever it wants unless the action was a violation of some state or federal law. Regardless of that, if your business is damaged because of false information given to the company by its employee, and he knew it was false, then you probably have a cause of action against the employee. If you have informed the company of the false information, and they have ignored the truth, you may have a cause of action against them as well.
