Conflict of interest Civil Suit

I would like to know if it is possible for someone to file a civil suit concerning a 23 year old conflict of interest case. A 16 year old juvenile was appointed an attorney to represent him in a murder case. This same attorney was also the legal advisor for the same Sheriffs Dept. that investigated the case. I doubt if there is any way you could get past the 1 year prescription period, even if you started counting when the juvenile turned 18. Even if the conflict was purposely withheld from the person, you would then have to prove that that conflict was the actual cause of damages. But nowadays, if the facts were such, you might find some judge who would allow such an action.
