Legal Question in Civil Rights Law in Louisiana
After going thru a couple of made up charges and arrests because of my Ex. When I got to court finally... it was dismissed, some of them never got to court. I was never able to prove my side or press charges on the other side because I was "accused". What can I do about this? What can I do about the false allegations and it just being dismissed? The charges in question are Aggravated Assault, Domestic Violence and Cyber Stalking. I feel I have plenty of proof on my side that easily shows it was all false and now not only my career took a major hit, my personal life is not healing well either.
1 Answer from Attorneys
If you can prove that the charges had no basis in fact or law, you can file a claim for malicious prosecution. Be forewarned that a malicious prosecution case is not one any attorney would take on contengency. You would have to pay a retainer and pay your attorney's fees and court costs up front.
