dismissal of protective order

I filed a protective order on behalf of my minor daughter. We decided not to pursue, so I've filed for a dismissal. I havent' been notified of the court date for the dismissal, so do I have to go to the impending court date that was set to obtain the order. In other words, does the filing of the dismissal ''protect'' me from going to the originally set court date to get the protective order. If I am a no-show, am I in contempt? I filed the complaint but will I be in trouble? Thank you.

If you are a no show, the rule will probably be dismissed. However, if you do what Mr. Lambert suggests and find out the case is still on the docket, I would tell you to show up so you can tell the court you changed your mind. If you fail to show, should you have to file another protective order, you may not be taken seriously.

Just to be safe, I would call the Judge's office and ask to speak to the Minute Clerk, who is in charge of the docket. Tell the minute clerk what you stated here and ask if the case is still on the Court's docket for the hearing date. Likely, the hearing will have been cancelled.
