Re: failure to protect

Schools act In Loco Parentis, which means "in the place of the parent". They have a legal duty to protect students with all reasonable means. They can and often are held responsible for injuries received by students who are attacked when the school could have taken reasonable steps to prevent the attack. As you can imagine, the analysis is extremely fact intensive. An attorney would have to know all of the surrounding facts prior to giving you any specific advise as to the liability of the school in your particular case.
