Legal Question in Civil Rights Law in Louisiana
I have an ex friend who was staying at my house. We agreed through text messaging that if she stayed she would have to pay $100 becuase she said that she will be gone by the 1st of that next month. It is now the 8th of that next month but of course things have went hay wire between us. Its not all about the money I am just upset that she can go on vacation for the weekend but can not help out the people that are letting you stay in there house. Well she has not been there in some time now but her stuff is still in the house. My question is can i keep her stuff in my house until she pays me the money? I also stated to her that every pay period that goes by for us that I will then add $50 to whatever it is that she owes. Our pay is every 1st and 15th of each month.

All of this for $100??? And she was to leave on the 1st and it is now the 8th? It is really the 9th, but it does not matter. You cannot simply keep her stuff until payment. She can sue you for that and get more than $100. And you cannot charge her $50 a pay period until she pays because that was not the agreement. What you can do is sue her and get a judgment for the $100. Then if after she is served with the suit and Judgment, you are not paid, you can seize her stuff and sell it.
