Legal Question in Civil Rights Law in Louisiana

Invalid warrant resulting in false arrest

In March 2002, I was pulled over by an officer who informed that he stopped me for a expired registration tag; the officer ran my license and when he returned to my car, and advised that there was a warrant for my arrest. When I questioned him, he advised that I had a warrant for contempt of court. I told him that this was an error, but the officer advised that he had to arrest me. My husband went to a bails bondman paid $375 for my release, as the bond was set at $3,000. I obtained an attorney who discovered in court that I had been arrested for a traffic ticket that had been paid 2 years prior to my arrest. This turned out to be an invalid warrant. As, the record showed that I had paid the ticket in question in 1999. Question: What are my chances of a favorable outcome. I have no prior arrest, and was not allowed to be released on my own recognance.

Re: Invalid warrant resulting in false arrest

The ultimate outcome of this depends on who was at fault in the computer not being updated. Without a doubt the arresting officer is not at fault in the scenerio you gave since he only executed the warrant his dispatcher said was outstandin. Have your lawyer backtrack the paper trail and see who dropped the ball.
